Home Procedures for Special Use Permits, Conditional Use Permits, Temporary Use Permits, and Rezoning

  1. Initial Staff Appearance. The applicant for a special use permit, conditional use permit, temporary use permit or rezoning shall contact the City Planner to schedule an appearance before the City staff. Staff meets regularly on the second and fourth Wednesday mornings of each month. The applicant should schedule a staff appearance with the City Planner and provide 20 copies of an initial development packet to the City Planner by 12:00 Noon on the Friday prior to the staff meeting to allow for distribution of the packet to staff members prior to the meeting. The packet should include an area map indicating where in the City the project is proposed; a written description of the proposed project/use describing the type of activities, buildings, employees, hours of operation, storage and parking needs; and a site plan of the property showing building locations, parking and loading locations, and unique site features such as floodlands, wetlands, steep slopes and location of drainage facilities. There is no fee for the initial staff meeting, however if the project requires subsequent staff meetings involving engineering review, the cost of such review will be the responsibility of the applicant.   2. Application Filed. Following the staff meeting, the application shall file a formal application with the City Planner, together with the appropriate filing fee, and 8 copies of the initial construction packet for review by the City Planner, the City Engineer, the City Water Operations Manager, the City Electric Operations Manager, the City Wastewater Operations Manager, the City Fire Department, the City Parks and Recreation Department, and the City Engineering Operations Administrator.

    The filing fee for a special use permit or a temporary use permit is $50.00.

    The Filing fee for a conditional use permit or a rezoning (text or map) is $300.00. Public hearing(s) required.

    The initial construction packet should include a site plan; a plan of operation; building plans; site grading, site erosion control and site drainage plans; utility plans; an outdoor lighting plan; a landscape plan; signage plans; and building elevations showing architectural detail, building colors and building materials. The formal application , filing fee, and initial construction packet for a special use permit or a temporary use permit should be filed with the City Planner by the third Monday of the month prior to the month at which Plan Commission consideration is desired. The application, filing fee, and initial construction packet for a condition use permit or a rezoning should be filed with the City Planner not later than the second Friday of the month prior to the month at which Plan Commission consideration is desired in order to allow time for the required Class II public notice.

  3. Revised Application Packet. Following review of the initial construction packet, the staff shall notify the Engineering Operations Administrator of recommended changes or additions to the plans. Comments shall be forwarded to the applicant who shall prepare and submit 32 copies of the revised application packet reduced to a sheet size not greater than 11" X 17" to the City Planner by the first Monday of the month in which the Plan Commission is to first consider the special use, temporary use, conditional use or rezoning application.

  4. Plan Commission Review and/or Public Hearing. The Plan Commission will review the special use, temporary use, conditional use, or rezoning application at their regular monthly meeting. The Plan Commission meets on the second Wednesday evening of each month. For special uses and temporary uses, the Plan Commission will consider the proposal and the City Planner’s recommendations; and take action to approve, approve with conditions, or deny the application. If approved the Plan Commission will direct the City Planner to prepare a special use permit or temporary use permit to be certified by the Mayor and City Clerk.

    Citizens will be given an opportunity to speak for or against a proposed conditional use or a proposed rezoning. For conditional uses, the Plan Commission will make findings regarding the compliance of the proposed use with the adopted comprehensive plan; its compatibility with neighboring land uses; the impact of the use on traffic, wetlands, environmental factors, public health, safety, and the general welfare; on the adequacy of public improvements, facilities, and services; and regarding whether the public benefits of the project outweigh the public liabilities. Based on the findings of fact, and the public testimony received at the public hearing, the Plan Commission will recommend approval or denial of the use to the Common Council; and will recommend appropriate conditions attendant to the use.

  5. Common Council Action. The Common Council shall receive the Plan Commission recommendation and shall act to approve the conditional use with appropriate conditions, or shall deny the use with reasons. The Common Council meets on the first and third Tuesday evening of each month. Similarly, the Common Council will either approve or deny with reasons ordinances proposing to amend the zoning map or text. Ordinances require a reading at two separate Council meetings unless the second reading is waived. In the case of a proposed zoning text change, the Common Council will conduct its own public hearing (in addition to the required Plan Commission public hearing) and citizens will be given an opportunity to speak for or against the proposed zoning text change prior to the Common Council taking any action.

  6. Architectural Commission Review. Following approval of a special use or conditional use involving new construction, the applicant shall present 15 copies of the Architectural Commission Review Packet reduced to a sheet size not greater than 11" X 17" containing the building elevations together with the Building Checklist for Final Inspection (indicating building materials and colors), a color rendering of the building, the signage plan together with the Sign Checklist for Final Inspection (indicating sign materials, size, and colors), and refuse dumpster location(s) and screening details to the Architectural Commission for review and approval. The Architectural Commission meets on the third Wednesday evening of each month. The Architectural Review Packet shall be submitted to the City Planner by 12:00 noon on the Thursday preceding the Architectural Commission. There is no fee for Architectural review, except when a special exception to sign regulations is requested. A sign special exception application requires a filing fee of $100.00 and must be filed at least 19 days prior to the Architectural Commission meeting at which the special exception is to be considered to allow time to publish a Class I public notice.

  7. Final Plans. Following final approval of a special use or conditional use involving new construction, 3 sets of the final approved plans with all required revisions shall be submitted to the Engineering Operations Administrator to be maintained in the permanent file for the project.
